Waste Collection Kennington Service Terms

These Terms and Conditions set out the basis on which we provide waste collection services in Kennington and surrounding areas. By making a booking, confirming a collection, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, landlord, tenant or organisation requesting or paying for the waste collection service.

Company, we, us or our means the waste collection service provider operating these Terms and Conditions.

Service means any waste, rubbish or recycling collection, clearance, removal, loading, transport or associated activity we provide.

Premises means the property, land, building or location where the Service is to be carried out.

Waste means any rubbish, materials, items or goods agreed to be collected or removed by us as part of the Service.

Contract means the agreement between the Customer and the Company for the provision of the Service, governed by these Terms and Conditions.

2. Scope of Services

We provide waste collection and removal services for domestic and commercial customers in Kennington and nearby locations. Our services may include one-off clearances, scheduled collections, bulky waste removal, and recycling collections as agreed at the time of booking.

The exact scope of the Service, including the type and approximate volume of waste, access arrangements, and any special requirements, will be agreed during the booking process. Any variations to the agreed Service may result in additional charges or rescheduling.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form or in writing, as made available by the Company from time to time.

3.2 When making a booking, the Customer must provide accurate and complete information, including:

a. Name and contact details of the Customer.

b. Collection address and any access restrictions.

c. A clear description of the type, quantity and condition of waste to be collected.

d. Preferred dates and times for collection.

3.3 The Customer is responsible for ensuring that all details provided are correct. If the information supplied is incomplete or inaccurate, we may amend the quotation, adjust the price, change the Service, or decline the booking.

3.4 A booking is only confirmed when we issue a confirmation by email, text message, verbal confirmation recorded by our staff, or other written communication. We reserve the right to refuse any booking at our discretion.

3.5 We will use reasonable efforts to attend the Premises at the agreed date and time, but all arrival times are estimates only and are not guaranteed. We are not liable for delays or failure to attend where caused by circumstances beyond our reasonable control.

4. Quotations and Pricing

4.1 Any quotation provided, whether verbally or in writing, is an estimate based on the information supplied by the Customer. The final price may change if the actual volume, weight, type or nature of the waste is different from what was described at the time of booking.

4.2 Our charges may be based on factors including, but not limited to, volume of waste, weight, loading time, access difficulty, parking costs, government charges or levies, and any additional labour required.

4.3 We reserve the right to revise the quotation on arrival if:

a. The waste differs from the description provided.

b. Access to the Premises or waste is restricted or unsafe.

c. Additional services are requested by the Customer.

4.4 If the revised price is not acceptable to the Customer, we may cancel the Service. In such circumstances, the Customer may be charged a call-out or attendance fee to cover our costs.

5. Payments and Invoicing

5.1 Unless otherwise agreed in writing, payment is due immediately on completion of the Service. We may require payment in advance or a deposit for certain bookings or larger clearances.

5.2 Payment methods accepted may include cash, debit card, credit card, bank transfer or other methods as notified by us. We reserve the right to refuse certain payment types at our discretion.

5.3 For business Customers with an approved account, payment terms will be specified on the invoice. If no terms are specified, payment is due within 14 days of the invoice date.

5.4 If payment is not received by the due date, we may charge interest on the overdue amount at the statutory rate permitted under UK law, accrued daily from the due date until payment is made in full.

5.5 The Customer is responsible for all costs and expenses incurred by us in recovering any overdue amounts, including legal and debt recovery fees.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by providing notice to us by telephone or in writing.

6.2 If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation fee will normally be charged, unless specific non-refundable costs have been incurred by us.

6.3 If the Customer cancels less than 24 hours before the scheduled collection time, or if our team attends the Premises and is unable to carry out the Service for reasons outside our control, we may charge a cancellation or failed attendance fee to cover costs.

6.4 We reserve the right to cancel or postpone a booking at any time due to operational issues, staff availability, vehicle breakdown, unsafe conditions, severe weather, access problems, or any events beyond our reasonable control. In such cases, we will seek to reschedule the Service as soon as reasonably possible.

6.5 Where a deposit or advance payment has been made, refunds will only be provided in accordance with this cancellation policy or as required by applicable law.

7. Customer Obligations

7.1 The Customer must ensure that we have safe and reasonable access to the Premises and the waste to be collected. This includes arranging necessary parking, providing keys or codes if required, and ensuring that driveways, entrances and passageways are clear.

7.2 The Customer must ensure that the waste to be collected is clearly identified and separated if necessary, and that no prohibited or hazardous materials are included unless specifically agreed by us in advance.

7.3 The Customer warrants that they have full authority to allow us to collect and remove the waste from the Premises. The Customer shall indemnify us against any claim by the owner or any third party claiming ownership or rights to the waste or items removed.

7.4 The Customer must not request our operatives to undertake any activity that is unlawful, unsafe, or outside the scope of the agreed Service. Our operatives may refuse to carry out any task they consider unsafe or inappropriate.

8. Waste Types and Regulations

8.1 We operate in compliance with relevant UK waste management legislation and regulations. Waste collected will be transported and disposed of or recycled at authorised facilities in accordance with applicable law.

8.2 The Customer must inform us in advance if any waste includes hazardous or specialist materials, such as chemicals, solvents, paints, clinical waste, asbestos, gas bottles, oils, batteries, electrical equipment requiring special treatment, or any material that may be subject to additional regulations.

8.3 We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, illegal, unsafe, contaminated, or outside the categories we are licensed or authorised to handle.

8.4 The Customer remains responsible for any prohibited or hazardous materials placed in the waste without our knowledge. If such materials are discovered, we may return them, charge additional fees for specialist handling, or report the matter to the relevant authorities where required.

8.5 We may provide advice on waste segregation and recycling options, but the Customer remains responsible for ensuring that information supplied to us about the nature of waste is correct.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Service. However, we are not liable for any loss, damage or cost arising from inaccurate information supplied by the Customer or from circumstances beyond our reasonable control.

9.2 While carrying out the Service, our operatives will take reasonable care to avoid damage to property. The Customer must notify us of any fragile surfaces, vulnerable structures, or particular risks at the Premises before the Service begins.

9.3 We are not liable for normal wear and tear or superficial marks that may occur during the movement of waste or bulky items, particularly in areas with restricted access.

9.4 Our total liability for any damage to property caused by our negligence shall be limited to the reasonable cost of repair or replacement of the damaged item, taking into account depreciation, and shall not exceed the total price paid or payable for the relevant Service.

9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under UK law.

9.6 We are not liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity or loss of reputation.

10. Title to Waste

10.1 Once we have loaded the waste onto our vehicle and received payment where due, title to the waste passes to us. From that point, we are responsible for the transport, treatment and disposal of the waste in accordance with waste regulations.

10.2 Prior to loading, all waste and items remain the property and responsibility of the Customer. The Customer must ensure that no items of value or personal possessions are included in the waste intended for removal.

11. Access, Health and Safety

11.1 We reserve the right to refuse or suspend the Service if our operatives consider that access to the Premises or the condition of the site poses a health and safety risk.

11.2 The Customer must ensure that children, pets, and other occupants are kept away from the working area while the Service is being carried out.

11.3 Our operatives may take photographs of the waste and working areas before and after the Service for health and safety, insurance and record-keeping purposes.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as possible, providing full details of the issue.

12.2 We will investigate complaints promptly and seek to resolve them in a fair and reasonable manner. We may request access to the Premises, photographs, or other information to assess the complaint.

12.3 Raising a complaint does not suspend the Customer's obligation to pay undisputed amounts due for the Service.

13. Data Protection and Privacy

13.1 We collect and process personal data such as names, contact details, service addresses and payment information, for the purpose of providing the Service, managing bookings, invoicing, and fulfilling our legal obligations.

13.2 Personal data will be handled in accordance with applicable UK data protection laws. We may share data with our staff, contractors, and service partners only to the extent necessary to deliver the Service or comply with legal requirements.

14. Variations to Terms

14.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the relevant Service.

14.2 Any variation to these Terms and Conditions requested by the Customer will only be valid if agreed in writing by an authorised representative of the Company.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the provision of the Service.

16. Severability

16.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be treated as modified to the minimum extent necessary to make it valid, lawful and enforceable, or, if such modification is not possible, it shall be deemed deleted.

16.2 Any invalid, unlawful or unenforceable provision shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written confirmation or quotation issued by us, constitute the entire agreement between the Customer and the Company in relation to the Service and supersede any prior discussions, correspondence or understandings.

17.2 The Customer acknowledges that they have not relied on any statement, promise or representation not expressly set out in these Terms and Conditions when entering into the Contract for waste collection services.
